No one can guarantee that the USPTO will issue you a patent. But we can provide the next best thing. For those inventors for whom we file both a utility and a design application on their invention, we offer our money back guarantee. 


If Wood & Eisenberg files both a utility and a design patent application on your invention and the USPTO fails to issue at least one patent, W&E will refund 50% of our attorney’s fees. The amount of refund will differ with each invention, but what this in effect means is that W&E will share the risk associated with the filing of a patent application with our clients. This is a true indication of the confidence we have in the quality of our work. 

Note: both the utility and the design application must be ordered at the same time and cover the same invention. The client must continue to pursue the patent during the USPTO prosecution phase and cannot elect to abandon the application. W&E’s refund applies only to attorney’s fees charged for the drafting of the original applications and does not apply to any fees associated with the application’s prosecution phase. The client must make all payments in a timely manner.
